Photography Contract & Model Release

1. Limited Liability and Indemnity: Fortheloved Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Fortheloved Photography's control, liability is limited to the rescheduling of the Engagement Photography Session. Client(s) agrees to indemnify and defend Fortheloved Photography against any and all third party claims, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of incidents or damages resulting from Client(s) actions or omission during Portrait Photography Sessions.
1. Model Release: This contract serves as a model release form. This grants the Photographer the right to use all images and footage without restriction for advertising, portfolios, and other lawful purposes. The Clients waive the right to inspect any images or footage from the events in this contract, and the right to restrict the use of the images or footage from the events listed by the Photographer.
1. Style: Client agrees that Client has spent a satisfactory amount of time reviewing Photographers work and understands that Fortheloved Photography has complete artistic control over the photo coverage as well as images on Event contracted above.
1. Permissions: It is the responsibility of the Client(s) to schedule and receive permission to use various locations for photography. If fees are required by a venue to reserve the location, it shall be Client(s) sole responsibility to pay for such fees and arrange for any necessary permits in advance.
1. Retouching Images: Basic retouching will be added to all images. Basic retouching includes global adjustments, (white balance, color correction, exposure, contrast, clarity, etc.) basic skin and beauty retouching and any other things seen to be fixed by the photographer that falls into a "basic" category. What classifies in this category falls under the photographers discretion. Any additional extensive retouching will incur an extra charge IF the client decides they would like it after receiving the gallery of images. Examples of extensive retouching would be (any body or weight changes, extensive blemishes, extensive beauty retouching, etc.)
1. Image Archives: The Clients acknowledge that the Photographer does not maintain archives of images and footage after delivering requested images and other goods to the Clients. All images will be available to download for (1) months. It it the Clients sole responsibility to request any desired prints, products or files within 30 days of their session. Client should download all images in custom gallery within (1) months of session date to ensure their photos are not deleted from Photographers online gallery archives. If Client neglects to download their files within (1) months time and the Photographer deletes their online gallery from archives, the Photographer is not held responsible.
1. Copyright: All photographs are and shall remain the sole intellectual property of the Photographer in accordance with the United States Copyright Laws. The Photographer grants the Clients permission to make the copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer.
BY CHECKING THE BOX BELOW, I HEREBY ACKNOWLEDGE THAT I HAVE READ AND AGREE TO ALL POLICIES SET FORTH BY FORTHELOVED PHOTOGRAPHY AS STATED IN THE PHOTOGRAPHY CONTRACT AND MODEL RELEASE.
